Terms of Service

These Terms govern access to Be The Investor (BTI), including its research tools, AI-powered Decision Support Systems, market data, community features and developer services.

By accessing or using BTI, you agree to these Terms and the policies referenced here. If you do not agree, do not use the platform.

Eligibility and acceptance

You must be at least 18 years old and legally capable of entering a binding agreement. If you use BTI for an organization, you represent that you have authority to bind it.

“BTI,” “we,” “us” and “our” refer to the Be The Investor brand and platform operator. These Terms incorporate our Privacy Policy, Investment Disclaimer, Refund Policy and any plan- or feature-specific terms displayed at purchase or activation.

What BTI provides

BTI is a technology and research platform offering market information, stock, ETF and digital-asset research, valuation models, screeners, portfolio and watchlist tools, simulations, risk analytics, news, educational content, community features, broker and affiliate information, AI tools including JINI, and developer API access.

  • Features, coverage, data sources and availability may change.
  • Certain outputs may be delayed, estimated, modeled, incomplete or generated by artificial intelligence.
  • BTI does not execute trades, hold customer assets, provide brokerage services or guarantee access to any financial product.

Decision Support Systems — not advice

All scores, rankings, personalized opportunities, portfolio observations, alerts, forecasts, fair values, model outputs and AI responses are Decision Support Systems for informational and educational use only. They are not investment advice, investment marketing, a recommendation, an offer, a solicitation, tax advice, legal advice or a fiduciary service.

Personalization reflects data and preferences available to the system; it does not establish suitability and must not replace independent research or advice from a licensed professional.

Accounts and security

You must provide accurate information, keep credentials and API keys confidential, and promptly report suspected unauthorized use. You are responsible for activity under your account and for maintaining secure devices and integrations.

  • Do not share credentials or bypass authentication, quotas or access controls.
  • We may require verification, suspend access or reset credentials to protect BTI and its users.
  • You may not create accounts through automated or deceptive means.

Acceptable use

You may use BTI only lawfully and within the permissions of your plan. Unless expressly authorized, you may not:

  • Scrape, harvest, crawl, bulk-download, resell, sublicense or redistribute platform data or content.
  • Reverse engineer, probe, disrupt, overload or attempt unauthorized access to BTI or its providers.
  • Use outputs to manipulate markets, facilitate fraud, violate securities laws, infringe rights or create misleading financial promotions.
  • Upload malware, unlawful content, confidential information you lack permission to use, or personal data of others without a lawful basis.
  • Misrepresent AI-generated or BTI content as independently verified professional advice.

Developer API

API access is licensed, not sold, and is subject to authentication, quotas, documentation and plan limits. You are responsible for your applications, end users, security, disclosures and legal compliance.

  • Do not expose secret keys in client-side code or public repositories.
  • Do not circumvent limits, cache beyond permitted periods or use the API to reproduce a competing data service.
  • We may throttle, rotate, suspend or revoke keys for security, abuse, nonpayment or material breach.
  • API schemas, endpoints, quotas and availability may change; you must design integrations to handle errors and interruptions.

Plans, billing and refunds

Paid features, subscriptions and usage-based services are billed according to the checkout terms and Pricing page. Taxes may apply. Unless checkout states otherwise, subscriptions renew automatically until canceled before the next renewal date.

  • You authorize the payment provider to charge the selected payment method.
  • Prices, quotas and plan features may change prospectively; material changes to an active recurring plan will be communicated where required.
  • Refunds, cancellations and statutory rights are governed by the Refund Policy and applicable law.
  • Failure to pay may result in downgrade, suspension or termination.

Third-party data and services

BTI relies on exchanges, market-data vendors, news providers, AI providers, payment processors, hosting services, brokers and other third parties. Their content may be delayed, unavailable, inaccurate or governed by separate terms.

  • Links and integrations do not imply endorsement.
  • Broker rankings, comparisons or affiliate links may generate compensation; compensation does not eliminate your duty to evaluate providers independently.
  • You are responsible for third-party accounts and terms you choose to use.

User and community content

You retain ownership of content you submit. You grant BTI a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format and display that content as needed to operate and improve the feature in which it appears.

  • Public posts, profiles, portfolios or comments may be visible and shared by others.
  • You must have all rights needed to submit content and must not post unlawful, misleading, abusive or infringing material.
  • We may moderate, restrict or remove content, but are not obligated to pre-screen everything.

Intellectual property

BTI and its software, branding, interface, original content, model presentation and compilations are protected by intellectual-property laws. Except for the limited right to use the service under these Terms, no rights are transferred to you.

  • Third-party market data and trademarks remain the property of their owners.
  • Feedback may be used by BTI without restriction or compensation, provided we do not identify you publicly without permission.

Changes, availability and beta features

The platform is provided on an “as available” basis. We may add, modify, limit or discontinue features, providers or coverage. Maintenance, outages, market events, third-party failures and security incidents may interrupt service.

  • Beta or experimental features may be less reliable and may change without notice.
  • You are responsible for maintaining copies of information you need and for verifying time-sensitive data at an authoritative source.

Disclaimers of warranties

To the maximum extent permitted by law, BTI is provided “as is” and “as available,” without warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation or results.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, BTI and its personnel, licensors and providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages; trading or investment losses; loss of profits, opportunity, data or goodwill; or claims arising from third-party content or services.

Where liability cannot be excluded, BTI’s aggregate liability for claims arising in the preceding 12 months will not exceed the greater of US $100 or the amount you paid BTI during that period. This limit does not apply where prohibited by law.

Indemnification

To the extent permitted by law, you will defend, indemnify and hold BTI harmless from claims, losses and reasonable costs arising from your unlawful use, your applications or content, your breach of these Terms, or your violation of another person’s rights.

Suspension and termination

You may stop using BTI at any time. We may suspend or terminate access for material breach, abuse, legal or security risk, nonpayment, or where continued operation is no longer practical. Provisions that by nature should survive will survive, including ownership, disclaimers, liability limits and dispute terms.

Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Except where applicable law requires otherwise, disputes will be brought exclusively in the state or federal courts located in New York County, New York, and each party consents to personal jurisdiction there.

  • Before filing a claim, the parties will attempt in good faith to resolve it through the Contact page for at least 30 days.
  • To the extent permitted by law, claims must be brought individually and not as a plaintiff or class member in a class, consolidated or representative action.
  • Each party waives trial by jury to the extent permitted by law.

General terms

If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; BTI may assign them in connection with a reorganization, financing or transfer of the platform.

We may update these Terms. Material changes will be posted with a new effective date and, where required, additional notice. Continued use after the effective date constitutes acceptance.
