UK Court Sets a Higher Bar for Claims on Seized Bitcoin

A $5 billion Bitcoin fortune is at stake, but UK court says being defrauded isn’t enough to claim it

A UK court ruled that Chinese law governs victim claims over more than 61,000 seized Bitcoin. Proving a fraud loss alone does not establish ownership of the specific cryptocurrency or its proceeds.

A UK High Court ruling has made recovery more complicated for Chinese investors seeking part of more than 61,000 Bitcoin seized by British authorities. Justice Mark Turner held that Chinese law governs the underlying ownership claims, rejecting an attempt to rely on English property and trust rules.

The ruling does not decide who receives the Bitcoin

The case stems from investment schemes operated through Tianjin Lantian Gerui Electronic Technology and related businesses between 2014 and 2017. The court's factual background described approximately 40.23 billion yuan collected through at least 128,409 contracts, while about 34.1 billion yuan was repaid to participants. Contract count is not the same as the number of individual victims.

Zhimin Qian converted part of the proceeds into Bitcoin and later moved to Britain. Authorities seized devices, private keys and other assets linked to more than 61,000 BTC. The October 12 decision addresses which country's law applies to ownership claims; it does not make a final distribution order.

Loss and property ownership are different questions

A person can prove that a fraudulent scheme caused a financial loss without proving a proprietary right in a particular asset bought with pooled proceeds. That distinction matters because a proprietary claim can rank differently from an ordinary compensation claim and may support tracing into substituted assets.

Under the court's approach, claimants must establish their rights under Chinese law. The source report says victims argued for English law or a combined approach, but the judge rejected that route. The result favors the prosecution's legal position at this preliminary stage without deciding that the UK government ultimately keeps the Bitcoin.

Why crypto makes the dispute larger

The value of the seized assets rose dramatically after the alleged fraud, creating a gap between historical cash losses and the current value of the Bitcoin. Any eventual distribution method must confront repayments already made, overlapping contracts and the legal link between each claimant's funds and the seized property.

Investors should watch the next ownership hearing, evidence on Chinese property law and any proposed victim-compensation framework. The present ruling narrows the legal route, but ownership and distribution remain unresolved.
